About these terms

These terms are the agreement between you and Nieuw Solutions, LLC, through its game studio nieuw.games (“we”) for playing Strata War: on stratawar.com, in the apps for iPhone, iPad, Mac and Android, and on game sites such as itch.io. By playing, you agree to them. If you don’t agree, please don’t play.

How we handle your data is in the Privacy Policy. In the apps from Apple’s App Store, Apple’s standard licence agreement also applies. Where it and these terms differ for those apps, Apple’s agreement wins.

The game

Strata War is free to play: the first two campaigns, every tutorial, skirmishes, online games for up to four players and the editor. It is in active development, so things will change, and sometimes break. We may change, add or remove features. We try to keep online play and sign-in running, but we can’t promise they will always be available.

Your progress is kept on your device and, if you sign in, with your account. We can’t restore the progress of a player who never signed in if their device loses it.

Accounts

You don’t need an account to play. If you make one, you must be at least 13, or older where the law says so, or have your parent’s or guardian’s permission. Keep the account you sign in with (such as Google or Apple) safe: whoever can use it can use your Strata War account. You can delete your account at any time in the game.

Playing fair

Please don’t:

• cheat, or use a bug to spoil a match for other players;
• attack, overload or try to break into our services;
• play under a name that is offensive or pretends to be someone else;
• use the game to break the law or to harass anyone.

If you do, we may end your match, remove your name, or suspend or close your account. If we close an account that has Premium Access because of this, we don’t refund it, unless the law says we must.

Things you make

Maps, missions and campaigns you make in the editor are yours. They stay on your device unless you share them. If you share one, you are responsible for what is in it. If you would like one included in the game, we will ask your permission first.

You are welcome to stream Strata War and to share videos and pictures of it.

Maps you publish for everyone

You can publish a map you made in the editor so other players can play it. Publishing needs a Strata War account, and, where the game says so, the Full Game or Premium Access. Before your first map, you agree to these rules. We look at every map before it is public, and we may turn one down without saying more than the reason.

A map you publish, and its name and words, must not:

• have offensive, hateful, sexual or violent words or pictures, including pictures drawn with the ground or the buildings;
• be somebody else’s map that you don’t have the right to publish;
• pretend to be from us, or from another player;
• advertise anything, or point people to other websites;
• break the law, or harass anyone.

You keep the rights to your map. By publishing it, you let us show it in the game and let every player play it, for as long as it is published. You can remove it at any time. If you delete your account, your maps are deleted too.

Anyone can report a map, or the player who made it, with Report. We read every report within two days. We take down maps that break these rules, and we may stop a player who breaks them from publishing, or close their account. Anyone can also hide every map by one player on their device.

Premium Access (subscription)

Premium Access is an optional subscription. Today it opens three more campaigns, Wayfare, Chord and Lumen, and lets you publish your own maps for everyone to play. Everything that is free stays free. It is not on sale everywhere yet. Where it isn’t, the game says so.

• Price. You see the price, in your currency, before you pay.
• Renewal. It renews automatically every month and is charged each time, until you cancel.
• Cancelling. You can cancel at any time. You keep Premium Access until the end of the month you have paid for, and you are not charged again. In the App Store, cancel at least 24 hours before it renews to stop the next payment. The Support page shows how to cancel in each store.
• Where you buy it. It is sold by the store you play in: Stripe on stratawar.com, Apple in the iPhone, iPad and Mac apps, and later Google Play in the Android app. That store’s own terms apply to the payment.
• One account, everywhere. Premium Access belongs to your Strata War account, so you must be signed in to buy it. It works wherever you sign in with that account. An account can have one subscription at a time. If you end up paying twice, write to us and we will refund one.
• Refunds. A month already started is not refunded, except where the law or the store’s own rules say otherwise. For the App Store, ask Apple at reportaproblem.apple.com. For Google Play, ask Google. For stratawar.com, write to us.
• If you live in the EU or the UK and buy on stratawar.com, you can change your mind within 14 days of buying and get your money back. Write to us.
• Price changes. If the price changes, we tell you before your next payment, and you can cancel before it applies.
• Deleting your account cancels a subscription bought on stratawar.com. It does not cancel one from the App Store or Google Play: cancel that in the store.

If we ever stop offering Premium Access, we will stop the renewals and tell you before we do.

What is ours

The game, its code, art, music, voices, story and name belong to us. We give you a personal, non-exclusive right to play it, which ends if you break these terms. Please don’t copy, sell or redistribute the game. Other games named on our site are trademarks of their owners. We name them only to describe and compare.

Our responsibility

We make Strata War with care, but we provide it “as it is”. As far as the law allows, we aren’t responsible for losses caused by using it, by it being unavailable, or by losing progress kept on your device.

Nothing in these terms takes away rights you have as a consumer under the law where you live. Nor does it limit our responsibility where the law doesn’t allow that, such as for harm caused on purpose or by gross negligence.

The law that applies

These terms are governed by the law of the State of Ohio, USA. If you are a consumer, you also keep the protection of the law where you live, and you can bring a claim in your own courts.

Changes to these terms

We may update these terms as the game changes. We change the date at the top when we do, and say so in the game if a change matters. If you keep playing after a change, the new terms apply. A change to the price or the terms of Premium Access applies only from your next payment.
